【摘要】 工业化和城镇化进程中,失地农民的权益保障存在诸多问题,如失地农民没有得到土地市场化的增值收益、再就业困难、社会保障体系不健全等。土地征收制度和产权制度存在缺陷是失地农民权益受损的主要原因,征地违法程序的救济渠道不畅是问题产生的重要原因。要从根本上解决失地农民的权益保障问题,必须明确土地产权,让失地农民分享土地的增值收益;建立有效的就业保障机制和完善的社会保障体系;在保障实体权利的同时,从程序上规范政府行为,实现城乡兼顾的包容性增长。更多还原

【Abstract】 In the process of industrialization and urbanization,there are many problems in the protection of the landless peasants’ rights,such as income,employment and the imperfect social security. Land expropriation system and property right system are the main reasons for the damage of land lost farmers’ rights and interests,and the relief channel of the illegal procedure is also the important one. To solve the problems,we must clear the land property rights,let the land lost farmers share the land value- added benefits,and establish an effective mechanism of employment security and improve the social security system. In the protection of the entity rights,it must regulate the government behavior,to achieve balanced growth of urban and rural areas.更多还原
