【摘要】 在社会学知识的"意义"日渐模糊的现代学术体制内,如何看待理论与经验研究的连接,本身已经构成需要认真思索的问题。通过回溯社会学自身对理论与经验关系的反思,将之与法社会学领域内的现有研究一一对照,由此尝试建立一个社会学知识的连续谱,希望可以说明,理论与经验研究的连接不仅是一个技术问题,而且必须建立在对社会学知识之社会意义的反思之上。在此基础上,将转向对法社会学研究多元路径的探讨。认为,理论反思与经验研究能否妥善连接,如何连接,是开展社会学研究的核心,也是评判一项社会学研究的关键。法社会学旨在透过社会层面的现象把握法律的社会性,从而对法律系统与价值体系提出理论性反思,这一核心宗旨决定了理论与经验连接对于法社会学的特殊重要性。更多还原

【Abstract】 It has become an issue calling for serious thinking how to achieve the connection between theoretical and empirical studies inside the modern academic system with an increasingly ambiguous definition of sociological knowledge.Through tracing back to the reflection of sociology on the relationship between theories and experience,this paper tries to make adetailed comparison between those reflections and the current studies in the field of sociology of law,so as to establish acontinuous spectrum of sociological knowledge and prove that the connection of theoretical and empirical studies is not only amatter of technology,but also based on the reflection on the social significance of sociological knowledge.This paper also explores the diversification path of study on sociology of law and suggests that the possibility and ways of connecting theorical reflection and empirical study is the core of sociological study and the key to evaluate asociological study.Sociology of law aims to grasp the sociality of law through phenomenain the social level to reflect theoretically on the system of law and value,which decides the special significance that the connection of theoretical study and empirical study has on sociology of law.更多还原
