【摘要】 根据建设用地现状,特殊土地权利人在拥有自身土地权利的同时,对相邻一定区域内建设用地的权利具有一定的限制要求,提出了在这一定的区域设立建设用地审议权和建设用地许可权,给出了定义,阐述了外延、内涵和特征;分析了建设用地审议权与许可权的异同点。这两项权利的设立既有法律依据,也有国家和地方法规条例作保障,既具可行性,现实中也有广泛实用性。更多还原

【Abstract】 According to the status of construction land,special land owners have their special land rights. Moreover,there are certain limits in certain area for construction land rights. The establishment of deliberative right and permission in a certain area describes the extension,the connotation and characteristics. The similarities and differences between deliberative right and permission of construction land are proposed. The establishment of these two rights is based on laws,and in accordance with the state and local regulations. The rights are feasible,and has a wide range of practicality.更多还原
