【摘要】 数字技术加速了信息流通,扩大了传统作品的范围,也提供了新的侵权方式。复制的高效、低成本极大地刺激了知识产权侵权。近年来,网络知识产权纠纷不断,尤其是在著作权领域。网络的即时、互通、多变在便利侵权人的同时,却为网络著作权人维权提供了不少的难题。本文以网页抄袭为例,分析权利人在维权过程中面临的种种困境,揭示传统著作权法在保护网络著作权中的不足,呼吁立法者加强对新技术的研究,完善相关立法,合理保护网络著作权。更多还原

【Abstract】 Digital technology not only accelerates the circulation of information, broadens the categories of traditional intellectual works, but also provides new ways of infringement. In recent years, there have been an increasing number of network intellectual property disputes, especially in the field of network copyright.The high efficient and low cost of copying tremendously stimulates the infringement of intellectual property. Characteristics of Internet are immediate, mutual, high efficient and changeable, which offers convenience for the infringer, but troubles the network copyright owner. In order to protect the network copyright, this article takes copying webpage for example, analyzing the dilemma of copyright owners in protecting their rights, revealing the deficiency of traditional Copyright Law, and appealing legislators researching on new technologies and new disputes to improve relevant laws.更多还原
