【摘要】 传统产品责任法经济分析是以缺陷产品之于社会发展的效益与受害人损失之净值为分析的逻辑支点,构建效率价值且视其为社会的善。现代产品责任法应对缺陷产品负效应所造成的社会价值伤害予以前提批判,立足消费者权益保护形成的新的效率观指引下实现向绝对责任的制度转向。应在国际视野下检讨效率价值在发展不平衡背景下具体实现的困境,以促进产品责任法领域的国际合作,并促成国际公约中实体规范的共同采用。更多还原

【Abstract】 The economic analysis of traditional product liability law takes the benefit of social development affected by flawed products and victims net loss as the logical fulcrum to build efficiency and value them as social good. Modern product liability law should provide premise criticism for the negative effect caused by defective products to the social value and turn to the absolute liability under the guidance system of new efficiency concept. From an international perspective,we should review the plight of concrete realization of the value of efficiency in the context of the uneven development,to promote international cooperation in product liability law,and favor common use of substantive rules in international conventions.更多还原
