【Abstract】 The new strategy of American trade secrets protection is an intellectual property policy which reconciles a series of protective mechanism such as diplomacy, trade, national security, judicial extraterritorial jurisdiction. Its implementation will provide feasible policy protection for the effective enforcement of American trade secret law.In essence, American government attempts to approach challenges from China and other nations that possess the late dominant position through diplomatic pressure and internal coordination mechanism in order to maintain its industrial competitive advantage and national economic security. The new strategy is to exert an extremely profound and extensive infl uence on China. It is necessary to be dealt with through specifi c measures from the overall and strategic perspective. First, it is to take the trade secrets as the core intellectual property and implement balanced protection of intellectual property. Second, it is to combine with stakeholders to inhibit internationalization of American unilateral intellectual property policy and to promote the internationalized unity of the protection rules through bilateral and multilateral negotiation mechanism. Third, it is to solve reasonably the problems of trade protection and double justice of the trade secrets according to the equivalence and comity principle.
