【摘要】 体育经纪人在推动体育产业发展的同时,也逐渐暴露出法规体系不健全,条款内容不完善,国家、地方和行业法规不兼容,立法体系和执法体系不配套等问题,导致经纪纠纷和法律冲突时有发生。就此问题,在文献研究基础上,运用调查、访谈、案例研究、逻辑分析等方法,对中美两国体育经纪立法管理的法规条款、管理对象与领域、服务内容、违规处罚及存在问题进行比较研究,并基于结论,对我国体育经纪市场的立法管理提出了加快行政法规和法律建设、加强行业协会监督管理及加强经纪理论与实践研究等建议。更多还原

【Abstract】 With driving sports industry progressing,sports agency is meeting some problems in the legislation administration such as imperfect law system and contents,those incompatibility among the state,local and sectors,and no matching of the legislation and execution etc.Focusing on above issues,we have done a comparative research on the law contents,objects and fields,service and penalty of the legislation administration in sports agency between U.S and China,then offer suggestions like enhancing administrative rules and laws construction,sector associations inspection and study of agency theory and practice.更多还原
