【摘要】 为应对日益严峻的气候变化问题,全球九个国家的专利机关纷纷推出绿色专利加速审查制度。这些制度从内容到形式可归纳为宽松型、适度型和严格型,目的均在于通过缩短专利审查时间以加快绿色专利授权。在评价与反思这一新制度的优劣得失之后,本文认为现有的绿色专利加速审查制度不足以解决气候变化问题,并提出规范绿色技术、提高公共资金资助的研发成果申请专利的条件、建设绿色专利数据库和绿色专利分类体系等信息平台是绿色专利加速审查制度得以可持续发展的重要保障。更多还原

【Abstract】 In response to the severe global climate change,nine countries in the world have launched the fast-tracking green patent regimes. These regimes are mainly divided into three types,which are loose,moderate and strict regimes,varying from the contents to forms,but have the same purpose to fast create green patents through shortening patent prosecution. Based on the evaluation and reflection of the pros and cons of these regimes,the article argues that the regimes are not sufficient for addressing global climate change. The specification of green technologies,the threshold of patentability of public-funded R&D and the construction of relevant green technology database and the classification of green patent are the key conditions for the sustainable development of green patent regime.更多还原
