【摘要】 在司法过程中,现有的理论大都认为法官能够以完全理性的方式思考问题,能够严格遵循法律程序得出结论。然而认知心理学的发展,验证了直觉机制在问题解决过程中的价值。法官对案件作出裁判的过程,很可能也是理性与直觉共同参与的过程。但是直觉在司法中容易出现偏差,因此,司法中需要培养理性的直觉与规制非理性直觉。更多还原

【Abstract】 In the judicial process,the existing theory argue that judges can thinking in a completely rational methods,to strictly abide by the legal procedures to conclude. However,the development of cognitive psychology,verified mechanism of intuition in the process of solving the problem of value. The judge’s decision process may also participate in reason and intuition. But the intuition in judicial decision prone to error,therefore,need to cultivation of rational intuition and regulation of non rational intuition.更多还原
