【摘要】 从非形式逻辑进路看,说服型对话理论和批判性讨论理论可以分析庭审对话的特点和过程,尤其是审判方的论证评估。从对话逻辑进路看,说服型对话系统主要关注起诉方、应诉方和审判方的会话行为和承诺,但是忽略了对论证的评估。庭审对话的逻辑分析应当吸收这两种进路的优点,发展包含审判方的论证评估和会话行为的庭审对话理论。更多还原

【Abstract】 This paper analyzes the dialogues in trial by applying informal logic and dialogue logic. According to the ap-proach of informal logic, it addresses the dialogues in trail as persuasion dialogues and shows the tasks and methods of evaluation made by adjudicators. According to the approach of dialogue logic, it introduces persua-sion dialogue systems and adjudication dialogue systems. Finally, it combines two approaches to analyze the theory of dialogues in trail with argumentation evaluation, and to define the speech acts of adjudicator in the perspective of evaluation theory.更多还原
