【摘要】 行政执法协商作为一种柔性的执法方式,有效地弥补了强制性执法的不足,充分彰显了"以人为本"的执政理念。但它也是一把双刃剑,在发挥积极影响的同时,存在着协商交易、假意协商、违法协商等滥用的风险。目前,行政执法协商这一新型执法方式还处在一个摸索前进的阶段。因而,只有进一步从执法裁量权、协商执法程序、执法人员素质、监督机制等方面提出相应的完善建议,才能使执法协商真正发挥出营造和谐执法秩序的目标。更多还原

【Abstract】 Consultations of administrative law enforcement is a flexible way of law enforcement,which effectively compensated for the lack of mandatory law enforcement and fully demonstrated the "people-oriented" ruling idea. However,it is a double-edged sword. On the one hand,it plays an active role; on the other hand,it also has the risk of abuse,such as the transactions of consultations,pretense of consultations and illegal consultations. At present,as a new way of law enforcement,the consultations of law enforcement still stay in the groping forward stage. So only improve the measures of enforcement discretion,procedure,the quality of personnel and supervision system,can it realize the target of harmonious law enforcement order.更多还原
