【摘要】 我国刑法中的"组织型犯罪"罪名共计有15个,分布于刑法分则的四章中,以罪名带有"组织"为标志,"组织对象"具有特定性。"组织型犯罪"与"有组织犯罪"存在包容与交叉两方面关系。应将我国的"组织型犯罪"重新构建为"组织、领导犯罪集团罪"、"组织、领导黑社会组织罪"、"组织、领导邪教组织罪"等罪名,而组织残疾人、未成年人乞讨罪则需要修改完善。更多还原
