【Abstract】 Constitution is law,which composes the origination of constitutional practices and constitutional theories,and which is also the normative premise and the logic base of constitutionalism. This proposition had been proved by the American case of Marbury v. Madison in 1803,which now has been accepted by those most countries which enacted written constitution. In China,a brilliant progress of the 1982 Constitution is that it determined the legal nature of constitution.
