【摘要】 2014年8月31日十二届全国人大常委会第十次会议表决通过了全国人大常委会关于修改《中华人民共和国安全生产法》的决定。修改后的《安全生产法》中新增第六十七条,为强化安全生产停产停业行政措施提供了法律依据。针对此条款,在研究国内外安全生产领域相关行政强制措施,分析日本和韩国等国家和地区的相关法规,以及我国治安、消防、环境保护等领域在采取行政强制措施的经验基础上,认为该条款符合我国安全生产领域的现实需求和政府行政管理特点,符合《行政强制法》的有关要求,增加安全生产强制停产停业措施是必要、合理和可行的。更多还原

【Abstract】 In August 31,2014,the Twelfth Meeting of the Tenth NPC Standing Committee voted through the revised " Law of the People’s Republic of China on Work Safety ". the new article sixty-seventh in the revised " The work safety law",in order to strengthen the safety production to provide a legal basis for the administrative measures to suspend production or business.
