【摘要】 民法上强调"私权神圣"的法律原则,而道德中注重"互帮互助"的行为准则,为平衡二者的关系,无因管理制度应运而生,因而被视为道德入法的典型。对无因管理制度目前已经有了不少研究,但对无因管理制度中不当管理尤其是不当管理的法律责任问题,目前还没有系统的研究。本文在对不当管理作出简要介绍的基础上,着重分析了不当管理的法律责任问题,最后,对构建我国不当管理制度提出了几点建议。更多还原

【Abstract】 Civil law emphasized that "private sacred" legal principles, and morality focus on "mutual assistance" code of conduct, to balance the relationship between the two, without due management system came into being, which is regarded as a typical morality into law. No reason for the current management system has been a lot of research, but no mismanagement by the regime, especially the issue of liability mismanagement, there is no systematic study. Based on a brief introduction to improper management, analyzes the issue of legal liability mismanagement, and finally, put forward some suggestions to build institutional mismanagement.更多还原
