【摘要】 自1905年《试办户部银行章程》颁行和大清户部银行建立,中央银行及其法律制度落户中华大地已逾百年,逐步成为我国核心性金融法律制度。对中央银行法律制度变迁进行历史考察,梳理中央银行的设立与法律制度生成均为政治选择结果、中央银行设立以财政功能为主、中央银行从"政府的银行"逐步向"银行的银行"演进等法律特点,这对深入理解我国中央银行及其法律制度具有现实的意义。更多还原

【Abstract】 It has been over 100 years since China’s Central Bank and its legal system began to operate in China after the promulgation and implementation of "the Regulations on Pilot Bank of the Ministry of Revenue in Feudal China" and the establishment of Bank of Ministry of Revenue in Qing dynasty.The Central Bank legal system has come to be the nuclear financial legal system.The present paper investigates historically the change of Central Bank legal system and analyses the legal characteristics of the establishment of China’s Central Bank and the formation of its legal system as the outcomes of political choices,the major fiscal function of the establishment of China’s Central Bank,and the evolution of China’s Central Bank from the "government’s bank" to the "bank’s bank".This investigation and the analysis is of practical significance to people’s thorough understanding of China’s Central Bank and its legal system.更多还原
