【摘要】 景区最大承载量制度有利于旅游资源、旅游者正当权益的保护和社会稳定。景区最大承载量应当由具有资质的机构测算,并由景区主管部门核定,且应依据客观情况而变更,景区对核定结果不服可以提起行政复议和行政诉讼。景区旅游者数量的控制应当同时采取抽签和排队方式,不宜采取价格机制,同时还应建立退票、实名购票、门票分配、数量监测等制度。景区违反景区最大承载量法律制度,应当分别承担民事责任、行政责任和刑事责任。更多还原

【Abstract】 The system of maximum capacity of scenic spot will help to protect tourism resource and legal rights of visitors,and it benefits to social stability too.The maximum capacity of scenic spot should be calculated by the qualified institution and approved by the scenic spot authority,and it should be variable with the objective situation.The scenic spots could launch an administrative reconsideration or administrative lawsuit when they were disagreed with the result of maximum capacity of scenic spot.The control measures of capacity of scenic spot should take ballot or queuing method other than price method based on the fairness considerations,which need a series of supporting systems,such as tickets return,real-name ticket,tickets allocation and visitors number monitor.Scenic spots will face civil responsibility,administrative responsibility or criminal responsibility,when they violate the system of maximum capacity of scenic spot.更多还原
