【摘要】 我国的司法体制深层次的矛盾不断凸显,在行刑与改造方面表现为行刑机制不灵活、行刑方式不规范,影响行刑功效的有效发挥。究其理论根源在于我国的行刑与改造理论和司法实践受刑事古典学派理论的束缚,重罪刑等价,强调报应刑,却忽视以犯罪人为中心,个别化和效益化的功利追求。犯罪学理论是以犯罪原因、犯罪对策为研究对象的科学,以犯罪学理论为依据,激活行刑机制,提高行刑功效,促进我国行刑与改造机制规范运行。更多还原

【Abstract】 With the reform of China’s judicial system,deep-seated contradictions have been exposed.The main problem in terms of performance and the transformation of execution is that the execution mechanism is not flexible,execution methods are not standardized,which affects the effectiveness of the execution.The theoretical roots in our execution and transformation theory and judicial practice are bound by the classical school of criminal theory,the equivalent emphasis on the crime and retribution are ignored.Criminology theory is the study of science based on the causes of crime and crime measures,its contents and penalties.Judicial practice of perfect execution and transformation theories are important.Thus,we propose crime theory be based on the activation execution mechanism to improve execution efficiency,in order to promote our execution and transformation mechanism to work well.更多还原
