【摘要】 针对近年来我国耕地违法违规占用屡禁不绝问题,剖析了其产生的主要原因,即:地方政府的主导、纵容和默许已成为耕地违法的首要原因;法律对地方政府和官员的土地违法行为没有真正起到约束和惩戒作用;农村集体经济组织及村民违法用地数量多,制止难度大;法律法规不健全,违法处理难;耕地保护意识薄弱。据此,提出了相应的对策建议,即:深化改革财税体制,减少地方政府对土地的过分依赖;加大对"耕地违法"官员的追责力度;将地方政府与官员对耕地的保护状况纳入政绩考核,并实行一票否;建立齐抓共管的耕地管理机制;强化耕地违法占用预警工作;增强耕地保护意识,建立社会责任监督机制。更多还原

【Abstract】 Aimed at the illegal occupied cultivated land despite repeated prohibitions,this paper analyzed the main reasons including that:the leading,conniving and acquiescence of local government have become the primary cause to break the land law;The law not really played constraint and disciplinary action on local government land illegal behavior;there were plenty of illegal lands in the rural collective economic organizations and the villagers which were difficult to deal with;laws and regulations were not perfect,farmland protection consciousness was weak.Accordingly,it put forward the corresponding countermeasures and suggestions including deepening the reform of finance system,reducing local government land dependency,strengthening the official responsibility and the performance evaluation related to farmland protection,establishing land management mechanism,strengthening farmland protection consciousness,and establishing social responsibility supervision mechanism.更多还原
