【摘要】 在深入推进依法治国的进程中,如何在实践中适用法律已经成为重中之重。法律方法论的研究在2012年中继续贴近司法实践的转向。在持续探讨基础理论问题的前提下,研究成果对微观问题、具体个案的关注比较明显。无论是在一般法理学中还是在部门法中,国内学者对法律方法论的实践特征给予了充分挖掘和探讨。就研究特色来说,法律修辞获得了更多的重视,从法律方法论视角研究案例指导制度涌现了不少成果,以史为鉴、聚焦制度成为法律解释研究的重点,法律渊源理论得到了创新性的扩展。完全有理由期待更具实践特征和实际意义的法律方法论。更多还原

【Abstract】 In the process of promoting rule of law in China,it’s very important for us to understand how to put law into legal practice.The research on legal methodology continues its trend of following practice in 2012.In addition to the study basic theories,researchers also focused on particular cases.Be it law or jurisprudence,Chinese scholars studying legal methodology paid great attention to practice in 2012.Special characteristics of research on legal methodology in 2012 include legal rhetoric,the case-guidance system,legal interpretation and legal sources.We have every reason to look forward to the legal methodology with greater practical significance.更多还原
