【摘要】 20世纪初至80年代末的很长一段时期,藏族部落纠纷解决研究多以对史料的挖掘、评述(国内)和田野深耕(国外)为主。进入社会转型期,藏族传统方式与司法的关系愈趋微妙、复杂,给藏牧区的纠纷解决实践带来诸多新的问题。正因此,学者逐渐转向藏族部落传统解纷方式在当代的表达之争。进入21世纪,更多的学者加入了这一行列,并取得了许多有价值的研究成果,同时也反映出一些问题与不足。本文拟对国内外的主要调查研究成果加以综述,并就某些问题提出自己的看法,以期为进一步的分析研究奠定基础。更多还原

【Abstract】 From the beginning of the 20th century to the end of 1980s,the exploration and comments on the historical materials (home) and the intensive field works(abroad) have been remaining the emphases in the research on the disputes resolution in Tibetan tribes.As China is now facing the social transit,the relationship between the traditional dispute-resolution mechanisms of Tibetan and the modern judicial mechanism became more complicated and subtle,which has,in turn,brought about many new problems in the practice of disputes-resolution in Tibetan pasturing areas.Realizing these new problems,people turned to study the future solution to reconcile new disputes.In the 21st century,more and more scholars have focused on the research and produced many valuable academic achievements,but at the same time,reflected some problems and defects.This paper is to summarize the main research results both home and abroad since the 20th century and to put forward some opinions for the purpose of further analysis and research.更多还原
