【摘要】 风险社会形态下,环境侵权的影响扩大、损害规模也扩大,仅仅根据传统侵权的个别责任将难以使受害人获得救济。通过建立环境侵权损害赔偿社会化分担机制将部分风险由国家和社会分担,以对受害人进行及时、有效的救济。借鉴域外相关经验,我国的环境侵权损害赔偿社会化分担机制的构建主要从环境责任保险、环境损害赔偿基金、财务保证、社会保障等制度的构建着手。更多还原

【Abstract】 in the background of a risk society,the impact of environmental tort expands and the damage scale also expands.While just according to the traditional tort individual responsibility,it is hard for the victims to get relief.We could establish the social sharing mechanism of environmental tort compensation to help the victims.Based on foreign experiences,social sharing mechanism is constructed mainly by the construction of liability insurance system,public damage compensation fund,financial guarantee,and the social security system.更多还原
