【摘要】 在我国的专利许可市场中,主要障碍就是对专利许可费的合理性难以确定。专利许可在专利法中存在的问题有:对专利费用的许可问题不详细,也缺乏灵活性,对其实践性的指导意义不大。实施专利技术许可要有具体的专利许可法规条文,要做到专利双方互惠互利,要完善专利合同法,对"平衡利益"进行细化,并运用到专利的实践中,创建专利典型区与活跃区。更多还原
