【摘要】 我国新修改的《民事诉讼法》将小额诉讼程序作为简易程序的一个组成部分进行了规定。小额诉讼程序的独立性具有现实基础、法理依据和程序功能,各国对小额诉讼程序进行了区别于简易程序的立法规范。我国《民事诉讼法》应采用在"第二编审判程序"中专章规定的立法模式建构小额诉讼程序规则,以实现案件真正的繁简分流,实现小额诉讼的低成本和高效率,进而满足民事司法大众化的时代需求。更多还原

【Abstract】 The updated Civil Procedure Law of PRC formulated related provisions on integrating the Small Claims Proceeding into the Simple Proceeding. The independence of small claims has the basis in reality, and also has the legal basis and its procedure function. All countries established standard legislation procedures for small claim proceeding which are different from the simple proceeding. For Civil Procedure Law of our country, we should build and establish the regulations for small claim proceeding based on the legislative modes of regulations specified in Chapter Two of Trial Procedure, so as to achieve the real separation of complicated cases and simple cases, to achieve the low cost and high efficiency of small claim proceeding and to further meet the requirements of popularity of civil justice in this era.更多还原
