【摘要】 法国的下文化遗产保护工作位居世界前列。其《遗产法典》较为细致地界定了海洋文化财产的范围,规定了所有权问题、发现报告问题、考古发掘问题和相关奖惩措施。实践中,法国注重国家船舶豁免权,通过协定方式合作保护有关遗产。中国相关法律可以参酌《遗产法典》的相关规定和具体实践,进一步完善水下文化遗产的发现报告制度和相关奖惩措施,增加对军舰等国家船舶的保护规定,增加对水下文化遗产的授权发掘规定,以期推动水下文化遗产的保护。更多还原

【Abstract】 France is taking a leading role in underwater cultural heritage protection.The French Code for Heritage provides a detailed definition of"maritime cultural asset",the ownership of such assets,the discovery report provisions,archaeological excavation as well as awards and punishments.In practice,France pays close attention to sunken warships and other state vessels,insists on its immunity,title and preservation,and tries to protect them by concluding bilateral or multilateral agreements.For China’s current laws and regulations,inspirations may be that the discovery report provisions as well as awards and punishments be improved,and provisions on state vessels preservation and authorized excavations for private parties be added.更多还原
