【摘要】 侵犯商业秘密行为极大地破坏了公平诚信的市场竞争秩序。为此,我国的立法和司法均加强了对商业秘密的保护。由于侵犯商业秘密罪被立法规制为结果犯,因此"重大损失"作为区分罪与非罪的重要标准,一直备受关注,加上立法和相关司法解释没有对"重大损失"的计算问题予以明确,故理论界和实务界的争议较大,影响了对侵犯商业秘密行为的打击力度。从"重大损失"的地位、内容、计算方法三方面对该问题进行探索,可以对立法和司法有所裨益。更多还原

【Abstract】 With the development of economic globalization,competition for business secrets becomes more and more intensive,which greatly damages the fair- play market order. Our legislation and jurisdiction strengthened the protection for trade secretes in order to solve the problem. The legislation clearly defines the business- secrets- related crimes as consequential Offense. To evaluate the result,heavy loss has become an important criterion to judge whether the activity is a criminal act. However,our legislation and jurisdiction give no clear answer to the calculation of heavy loss. This situation causes great disputes between the academic professors and the judicial members and weakens the punishment effect for trade secrets offenses. This article intends to explain the status,content and calculation methods of heavy loss in order to provide some benefit for legislation and jurisdiction.更多还原
