【摘要】 中国农村土地制度的改革关系到中国农村经济乃至整个国家经济的兴衰,中国农村土地制度的变迁映射了中国社会转型的进程。农村土地承包经营权的有效流转,对于实现农村土地资源的优化配置,推进中国社会转型、农村社会和经济稳定发展具有重大意义。文章界定农村土地承包经营权流转的概念和流转制度的发展历程,从农村土地产权制度安排、农村村民自治权异化、农村土地的社会保障功能和土地资源的天然局限等角度分析转型期农村土地承包经营权流转过程的制约因素,为进一步推进农村土地承包经营权流转提出努力方向。更多还原

【Abstract】 The reform of Chinese rural land system is related to the China rural economy and even the entire national economy,China’s rural land system transition mirrors China’s social transformation.The right to the contracted management of rural land effective circulation,to achieve the optimal allocation of rural land resources,and promote our country’s rural social and economic stability and development is of great significance.This paper defines the right to the contracted management of rural land circulation and the concept and the development of the circulation system of the process,and then analyzes the restriction in rural contracted management land circulation process from the rural land property rights system arrangement,rural villagers autonomy alienation of rural land,the social security function,land resources,in order to further promote the contracted management of rural land circulation.更多还原
