【摘要】 从理论上来说,实现刑法的明确性是刑事立法与刑事司法的共同任务。刑事案例指导制度作为一种刑法适用的解释机制,其所确立的裁判规则是对相关刑法规范的精确化和具体化,可以起到解释、明确、细化刑法的作用。指导性刑事案例是刑法规范与司法实践相结合的产物,通过指导性案例解释刑法规范,不仅具有更强的针对性,能更直观地揭示刑法条文的含义,而且对法条中所蕴含的法律精神和立法意旨的阐释也更为准确和清晰,可以保证相同或类似案件得到相同或类似的处理,减少和消除同案不同判、同法不同解的现象,有助于实现刑法适用的统一性。更多还原

【Abstract】 In theory,the clarity of criminal law shall be established through the joint efforts by legislators and judicial organs.The criminal case guidance system as a form of interpretation of criminal law,the rules of adjudication it has established is clear and specific of the ambiguity criminal law rules,therefore,the case guidance system plays an important role in the clarifying process of criminal law provisions.The guiding case is the combination of criminal rules and judicial practice.By means of the guiding case,not only can more accurately reveal the meaning of the rules of criminal law,and the interpretation of the statute is more intuitive,more clearly.Thus the case guidance system can guarantee that the same or similar cases the same or similar treatment,so as to realize the unity of the application of criminal law.更多还原
