【摘要】 根据民法上的信赖保护原则和诚实信用原则,形成了秩序与正义兼备的民法体系。信赖保护原则所体现的契约精神,反映了权利形成上的形式理性的意义,也是建立具有可预测性的法律关系的基础。但是权利(法)可能发生异化,而诚实信用原则恰恰可以通过衡平的法律技术纠正权利对公正的偏离,但我们也应当防范诚实信用被滥用而导致的流弊。更多还原

【Abstract】 The civil law system,with characteristics of both justice and order,was built up under civil law principles of "Reliance Protection"and "Good Faith". The contractual spirits rooted in the "Reliance Protection"principle reflects the significance of formal rationality in the process of forming a right. This principle is also the basis of forming a predictable legal relationship. However,the rights might be abused and deviate from the justice. In such cases,the "Good Faith"principle exactly corrects such deviations through using techniques in Equity. But we should also avoid the problems caused by the abuse of "Good Faith".更多还原
