【Abstract】 The conflict’s functional theory of Lewis Coser provides a Research Paradigm for presenting the statement of the justice sublating the public opinion.Based on the point of the public opinion affecting the judicial,we analyze its’ function.The function refers to the negative functions and the positive functions.The negative functions include that the public opinion affecting judicial independence and judicial justice.The positive functions of public opinion have the following aspects: restricting the administrative authority interfering in the judicial,providing multiple reference value,and enhancing the acceptability of judicial judgment.Through the analysis,the paper provides sublation strategies for the justice absorbing the public opinion,including screening and guiding the public opinion and the communication and feedback with the public opinion.更多还原
