【摘要】 当今社会人们与互联网日渐密切的联系也使公民个人在网络世界的虚拟财产不断膨胀,网络用户死亡后的"虚拟遗产"虽然有着与现实世界财产不同的型态和特点,但它仍符合"其他合法财产"的判定标准,可以纳入遗产继承的范畴。网络用户对不同类型的虚拟财产分别享有所有权或使用权,在其作为遗产继承时的方式也有所区别。此外,在虚拟遗产继承时,还必须注意网络用户协议中限制虚拟财产继承的条款的法律效力,协调平衡继承权的实现与网络秩序维护之间的关系。更多还原

【Abstract】 Now,people increasingly closely contact with the Internet and the virtual property of the individual citizens in the cyber world is expanding more and more.The "virtual estate" after the death of internet users has different types and features with the real-world property,but it still meets the criteria which is used to determinant "other lawful property" and should be included in the scope of inheritance.Internet users enjoy ownership or right to use with different types of virtual property,which also determines the different mode of inheritance.In addition,we should note the terms’ legal effect in the network user agreement which limits inheritance of the virtual property to harmonize and balance the relationship between the right of inheritance and the network order.更多还原
