【摘要】 文学理论中,对作品的理解和解读,存在"模仿说"、"表现说"、"再现说"、"文本说"、"读者说"、"产品说"等诸多观点。而作者权体系的著作权法借由浪漫主义的"表现说"而建立,版权体系著作权法的作品观与"产品说"契合。这些被采纳的作品观是对文学理论中作品观的选择和取舍。明确著作权法视野下的作品观将对著作权的理论研究和法律实践产生重要的意义。更多还原

【Abstract】 There are many views on the understanding and interpretation of works in literary theory, such as "Imitation", "Expression", ’’Reappearance", "Text", "Reader" and "Product". Author’s rights in the European continent were built on the base of "Expression" of Romanticism, and the view on works in Copyrights in common law system is related with "Product" of the Marxist Literary Theory. These views on works adopted by copyright law are from the literary theory. The discussion of the views on the works will have important significance on the study and practice of the copyright law.更多还原
