【摘要】 指出中国电网企业因其自然垄断地位在市场上极可能产生滥用市场支配地位的行为;中国行业规制法的缺位使得《反垄断法》成为在这一领域适用的法律根据;但《反垄断法》在规制电网企业滥用市场支配地位的行为时存在一些问题;在借鉴欧美等国相关的立法经验的基础上,结合中国实际进行了探讨,提出应对中国电网企业的拒绝交易、垄断价格、差别待遇以及其他限制竞争的滥用市场支配地位的行为进行严格规制,以完善《电力法》。更多还原

【Abstract】 Taking advantage of their natural monopoly position,it is most possible for grid enterprises to have the behavior of abusing their dominant position in the market.Because of the lack of corresponding Chinese industrial regulation law,the Anti-monopoly Law becomes the applicable law in this area accordingly.However,there exist a number of problems in the application of Anti-monopoly Law to the abuse of dominant market position by grid enterprises.Based on the use of relevant legislation experience of the US and European countries for reference,and combined with Chinese practice and corresponding exploration,I propose that it is mandatory to conduct strict regulation on the behaviors of China’s grid enterprises in abusing the dominant position in the market,such as,refusal to deal,price monopolization,differential treatment and competition limitation,etc.to perfect the Electric Power Law.更多还原
