【摘要】 宪法最高权威性不仅体现在形式上,更重要的应体现在实质上。然而我国的宪法权威却是缺失的。缺乏市场经济的支撑,宪法权威失去了经济基础的保障;政党制度可操作性的空白与发达民主政治的缺乏,使宪法权威失去了政治层面的维护;思想上宪法意识和宪法信仰的薄弱,无力支撑宪法权威;在法律层面上,违宪审查制、司法实践中的回避更进一步将宪法权威与人们生活之间的距离拉远,缺失也就成为情理之中的事情。更多还原

【Abstract】 As the core of a country’s legal system,the constitution,which is a country’s fundamental law,should have the supreme authority that lies not only in form,but also in essence.However,studying of Chinese present constitution,we can get the conclusion that the constitution lacks of authority.Analyzing the reasons of the absence of constitution authority in China,we can get the answers from the economy,ideology,system and the judicial practice.The constitution is the product of the market economy.Without the support of the developed market economy,the constitution authority lacks of the ensurance of its economic foundation.Without the support of the developed democratic politics and the political party system the constitution authority lacks of the ensurance of its political foundation.However,the establishment of the constitution authority finally lies in people’s constitutional awareness and belief.The weakness of the constitutional awareness and belief can not support the constitution authority.The absence of anti-constitution review provides room for the anti-constitution behavior.What’s more,the abstention in the judicial practice widens the distance between the constitution authority and the people’s life.All these factors destroy the constitution authority.The lack of the constitution authority is reasonable.更多还原
