【摘要】 随着网络技术的迅猛发展,网络服务中的著作权间接侵权行为呈不断上升趋势。在图书馆网络服务过程中,也出现了相关的诉讼案件,但目前关于图书馆网络服务著作权间接侵权的相关研究,无论在理论方面还是在立法实务中,还没有针对性的研究成果。依托现行著作权法间接侵权规则,结合图书馆提供的具体网络服务模式,通过分析研究图书馆构成著作权间接侵权行为的主客观要件,提出了介于主体的特殊性应当享受一定的权利空间的论断。更多还原

【Abstract】 Indirect infringement of copyright has increased continuously with the development of internet technology,and libraries have also the same cases in recent years.However,theory and legislation about libraries’indirect infringement of copyright have been inadequate.Based on the related laws,the article analyzes subjective factors and objective factors of libraries’indirect infringement of copyright according to libraries’internet information services,and suggests that libraries should gain more rights because of its special identity.更多还原
