【摘要】 在中国共产党领导的晋冀鲁豫边区政权法制建设中,对贪污腐败问题进行了专门立法,即1942年《晋冀鲁豫边区惩治贪污暂行办法》。文章通过对其在当时边区政权立法体系中的地位,它的立法程序、立法技术、相关配套法规以及实践效果进行综合系统研究,对抗战时期中国共产党惩贪运作机制进行从立法到司法、从文本到实践的动态剖析,可以为今天的反贪机制提供一种历史维度的解读,为当代反腐的刑事立法及实践提供有益借鉴。更多还原

【Abstract】 In CPC controlled Shanxi-Hebei-Shandong-Henan Border Region,the construction of regime and law system was pushed forward during the Anti-Japanese War.Corruption is of primary concern and special legislation was conducted for it,that is,"Provisional Measures on Punishing Corruption in the Shansi-Hopei-Shandong-Henan Border Region" in 1942.Through a comprehensive and systematic research into the position,legislative process,legislation technology,relevant supporting laws and the application effect of this special legislation in the system of political power and legislation at that time,this paper is devoted to analyzing the operating mechanism of punishing corruption from law making to judicial practice and from the theory to practice.This analysis is aimed to provide a kind of interpretation of historical dimension for the anti-corruption mechanisms nowadays,which is not only helpful for us to have a better idea of the contemporary legal institutions in the historical era,but also provides useful reference for the further development of anti-corruption criminal legislation and justice.更多还原
