【摘要】 消费者后悔权制度在其他国家和地区被称为冷静期制度,这项制度是指消费者在商品交易合同履行完毕之后的一定期限内享有无条件退货的权利,这对处于弱势地位的消费者来说具有特殊的保护作用。在国外,冷静期制度在商品交易领域早已被广泛应用,后悔权是消费者的一项重要权利;而在中国,后悔权制度却鲜为人知。在现今消费者主权时代,后悔权有其建立的合理性与必要性,我国应当借鉴国外冷静期制度,适度修正相关法律制度,构建后悔权制度,将其上升为法定权利,以便更好地保护消费者权益。更多还原

【Abstract】 Consumers regret right system in other countries and regions,the proxy statement system called system means that consumers in commodities trading after the contract within a certain term enjoys the rights of the unconditional return of disadvantaged,the consumers with special protection.In a foreign country,proxy statement in commodities trading system have been widely applied field,regret right is an important consumer rights,while in China regret right system,but little-known.This paper focuses on the regret right system analyzed the existing theories foundation,and combining the current legislation and practice,think in the current era of consumer sovereignty,regret right has its build rationality and the necessity,our country should adopt foreign proxy statement system,moderate fixed related legal system,building regret right system,its rise as a legal rights,so as to better protect consumers’ rights and interests.更多还原
