【摘要】 近年来,竞技体育不正之风蔓延,"假赌黑"、服用兴奋剂、修改年龄等事件层出不穷,中国竞技体育亟需用法律对其进行全方位的规制。应采取的措施主要有:界定体育行政管理机关的管理权限和体育社会团体的自治管理权限,探索设立专门的体育仲裁机构,建立与体育社会团体自治范畴有效对接的体育仲裁规则;确定专门的体育博彩监管部门,将发行销售与监督相互分离,加强预防与制约的制度设置,以疏代堵;将违反兴奋剂管理的行为纳入《刑法》规制范畴,明确兴奋剂查禁的主体、对象、权限、强制措施范围、程序等,并在查禁中配合信息公开、查禁人员回避、被查禁人权利救济等相关制度。更多还原

【Abstract】 Many malpractices in recent years,such as the issues of match-fixing,gambling,doping,age-modifying,have been frequently reported,which makes Chinese competitive sports confront a great challenge.Consequently,there is an urgent need to build a full range of legal regulation on these malpractices.However,the present legal regulation in competitive sports is unable to meet requests of the complex social reality.This essay aims to analyze several difficulties in legal regulations of Chinese competitive sports and propose some suggestions as follows.First,we should define the privileges of sports administrative authorities and sports community groups,establish specialized institutions of sports arbitration,and set up effective sports arbitration rules which can dock with privileges of autonomous groups in sports community.Second,we should establish specialized regulatory authorities of sports lottery,separate the sales from the supervision of lottery,and strengthen the prevention and constraints of the system settings.Last,we should put the anti-doping management under the regulation of Criminal Law,clarify several key factors in stimulants ban,and assist the above measures with some corresponding supporting systems.更多还原
