【摘要】 为了完善刑事证据收集与认定的相关理论并为刑事司法实践提供有益的参考,文章针对刑事证据收集活动中存在的取证不全、单独讯问、程序不严格等问题,提出在刑事证据收集活动中应当遵循全面取证、合法取证、及时取证、反对强迫自证其罪等规则。在此基础上,针对收集的各种证据,笔者从孤证不能定罪、验证关系需细节化和坚持排斥性原则等方面探讨了刑事诉讼证据的认定方法,以期为刑事司法实践提供有益的参考。更多还原

【Abstract】 In order to improve the relevant theories of collecting and identifying criminal evidences and to provide a helpful reference for criminal judicial practice,this article put forward suggestions that we should abide by the principles of obtaining evidences comprehensively,legally,timely and apposing self-incrimination etc.to the existing problems concerning incomplete evidences,separate interrogation and less strict procedures etc.in the activities of collecting criminal evidences.On that basis,this article probes into identification methods of criminal lawsuit evidences to all kinds of collected evidences from the aspects of not being convicted by isolated evidence,validating the relationship in detail and sticking to the principle of exclusion etc.in the expectation of providing a helpful reference for criminal justice practice.更多还原
