【摘要】 从实然的选举权与被选举权"紧密结合论"和应然的"相对分立论"解析,人大代表选任资格较一般选民资格应更高、更严;我国长期奉行人大代表选任资格等同于一般选民资格,条件宽泛、标准简省,与人大代表尊崇的政治法律地位和职责使命要求不相称;应建构公民政治权利能力和政治行为能力概念,科学立法设计人大代表选任资格,有利于优化提高人大代表素质能力,促其积极高效地履职尽责。更多还原

【Abstract】 In reality,citizens’ right to vote are closely related to the right to be elected.However,they should be separated.According to this,the qualification of the representatives of the People’s Congress must be higher and stricter than that of general representatives.But they are equal to each other in China,which is in conflict with the political,legal status and mission of representatives of People’s Congress.Therefore,it is high time that we enhanced civilians’ the political rights and political ability.What’s more,it is essential that we should make laws in a scientifically way to establish qualification of the representatives of the People’s Congress,which is beneficial to improving their ability and thus promote them to perform their duties actively and efficiently.更多还原
