【摘要】 抗虫棉是中国首个实现产业化种植的转基因作物,自1996年以来,推广抗虫棉取得了巨大的社会效益和经济效益,但是频频发生的专利纠纷严重影响了抗虫棉的产业化进程。通过对典型专利纠纷的梳理,结合抗虫棉的产业化模式,深刻分析系列专利纠纷发生的症结——利益不平衡,进而从宏观、中观和微观3个层面,提出抗虫棉产业化的专利纠纷防范对策,可为其他转基因作物产业化提供参考。更多还原

【Abstract】 Genetically modified cotton is the first industrial cultivation of transgenis pest-resistant crops in China.Promoting transgenis pest-resistant cotton has made tremendous social and economic benefits since 1996,but the high incidence of patent disputes seriously affect the industrial process of transgenis pest-resistant cotton.Through clarifying the typical patent disputes,combing industrial models of transgenis pest-resistant cotton in China,and profoundly analyzing the crux of the series of patent disputes-the imbalance of interests,measures to prevent patent disputes in our industrialization of transgenis pest-resistant cotton were proposed from the macro,medium and micro levels.Thus it could provide a reference for the industrialization of other transgenis pest-resistant crops.更多还原
