【摘要】 从国际公约、国内法律相关条文出发,指出船员服务簿作为船员从业许可证和培训合格证的实质;将船员服务簿的内容分为静态基本信息和动态记录信息,并总结各部分信息的作用;论述船员服务簿上船长、船公司和海事管理机构的记录要求及法律地位;以国际公约为依据,考究发达国家相关法律规定,结合中国的法律实践,提出建立服务簿信息保护制度和取消在服务簿上记载海事管理机构的检查记录的建议。更多还原

【Abstract】 According to the international conventions and the national laws,this paper pointed out the nature of the seaman’s record book as the seaman’s license and the training certification,divided the content into the static fundamental information and the dynamic recording information,and summarized the role of each part;discussed the record requirements of captain,shipping company,maritime administration for seaman’s record book and its legal status;based on international conventions,it also investigated relevant laws and regulations of developed countries combined with legal practice in China,put forward some advice on how to keep the basic information secret and cancel the maritime administration’s records about the faults of the seaman.更多还原
