【摘要】 随着数字图书馆的快速发展,基于数字图书馆的网络侵权纠纷已经成为制约数字图书馆发展的主要瓶颈之一。如何利用归责原则对各种侵权行为进行责任认定,为数字图书馆在建设和服务过程中避免侵权提供具体的建议,新颁布的《侵权责任法》为问题的解决提供了契机,但该法也应在特殊侵权行为中增设章节专门规定网络侵权行为,并将数字图书馆作为网络侵权特殊主体来规制。更多还原

【Abstract】 The internet infringement has seriously influenced the development of digital libraries.How to confirm the responsibilities of all kinds of torts using the criterion of liability,which can provide specific suggestions for digital library avoiding infringement,the new Tort Liability Law will be helpful to solve this problem,and it is better to add internet infringement in special tort conducts regarding digital library as a special subject.更多还原
