【摘要】 我国矿业权一级市场交易制度初步建立,体现了公开、公平、公正的市场原则,实现了矿业权的市场配置,显化了矿业权的市场价值。矿业权市场完善建议:(1)尊重客观规律,严格实行分类出让,不搞"一刀切",科学设置出让条件,不把"价高"作为获取矿业权的主要因素或唯一因素;(2)矿业权招拍挂出让需符合相关政策、规划及矿业权设置方案;(3)完善矿业权招拍挂出让程序与制度,确保公开、公平、公正,维护好矿业权竞得人的利益和国家财产权益;(4)加强"交易平台"与矿业权评估、矿产资源储量评审等中介机构建设,完善矿产资源储量管理制度和矿业权价值评估方法;(5)加强矿业权市场建设的理论研究,夯实矿业权市场交易的基础。更多还原

【Abstract】 Trade practices of primary market of mining right initially established in China embody the openness, fairness and impartiality market principle, achieve the market allocation of mining right, and show the market value of mining right. For improving the market of mining right, it is proposed to (1) conform to objective law, execute classified strict transfer instead of rigidity uniform, set transfer condition scientifically and stop to taking "high price" as the main or only factor for mining right acquisition; (2) invite bid for, auction, offer and transfer mining right according to relevant policy, plan and setup scheme; (3) improve bid inviting, offering, auctioning and transferring procedure and system of mining right to assure openness, fairness and impartiality and safeguard interest of winner and property and interest of the state; (4) strengthen construction of Trading Platform and intermediately agencies for mining right evaluation and mineral resources/reserves review and others and perfect mineral resources/reserves management system and mining right evaluation method; and (5) promote theoretical research on construction of mining right market and solidify foundation for market transaction of mining right.更多还原
