【摘要】 随着器官移植技术的迅速发展,许多危重症患者的疾病因此得到救治,然而器官移植为人类医学救死扶伤带来福音的同时也引发了大量刑事法律问题,尤其是器官供体数量严重不足导致器官买卖行为的泛滥,给我国社会带来严重的危害性。鉴此,十一届全国人大常委会第十九次会议表决通过的《中华人民共和国刑法修正案(八)》明确规定了组织出卖人体器官罪。本文以组织出卖人体器官罪的法律适用为主题,从组织出卖人体器官罪的构成要件、罪与非罪、此罪与彼罪为出发点,对司法实践中可能涉及的主要疑难问题进行分析。更多还原

【Abstract】 With the rapid development of organ transplant,many critically ill patients are cured of their diseases.Meanwhile,organ transplant also sparked many criminal legal issues,especially the serious harm to the society in China which resulting from the flood of organ trade due to the serious shortage of donors.Therefore,the Crime of Organizing and Selling Body Organs is explicitly stipulated in The Amendments to the Criminal Law of People’s Republic of China(eight) voted through on the 19 th meeting of the 11 th NPC standing committee.Focusing on its legal application,this paper analyzes the problems involved in its practice on the basis of its key components,crime and non-crime,this crime and other crime.更多还原
