【摘要】 旅游侵权的法律治理对于国家旅游业战略的实现至关重要。遵循法律的逻辑与灵魂,旅游侵权仅指依法对旅游者行使旅游权承担义务或职责的旅游活动主体,侵害旅游者合法权益,应当依照旅游特别法的规定,承担特殊民事责任的侵权行为,非指一般性的侵权行为。旅游业经营者违反安全保障义务侵权、旅游辅助人侵权、旅游业管理者或国家相关职能部门违反职责侵权以及多原因力旅游侵权是旅游侵权的典型形态,侵权人除须承担财产和人身方面的常规赔偿责任外,还须承担精神损害和惩罚性赔偿民事责任。更多还原

【Abstract】 The legal remedy to travel tort plays a very important pole as to accomplishing national travel strategy.Travel tort,according to the soul and logic of law,should be a tort which burdens with special civil liability in the light of special travel laws and regulations,and from some who has the duty of not obstructing the travel right of traveler.It is not a common tort.Those actions are typical travel torts such as tourism practitioner violating safe-protection duty,tourism-assistant infringing,tourism governor or relevant department of tourism government infringing,and multitude cause travel tort,which lead to not only general damages but also spiritual damages and punitive damages.更多还原
