【摘要】 新制度经济学的制度变迁理论,为研究我国石油储备法律制度提供了一种别样的思路与方法。外在环境的变化以及立法资源配置均衡化的诉求,推动着石油储备法律制度的生成,引导着石油储备立法与体系的整体图景建构。实现石油储备安全战略的法律路径,要求石油储备法律制度从总体与具体两种框架模式展开——石油储备法立法体系与具体法律制度的设计,并最终为我国能源安全与国民经济发展提供制度保障。更多还原

【Abstract】 The theory of institutional changes,which was put forward by the New Institutional Economists,provides a different kind of thinking and methods for the studies of China’s legal systems of petroleum reserve.Changes in the external environment as well as the balanced allocation of legislative resources demand the establishment of legal systems of petroleum reserve and guide the framework of such legal systems.In order to meet the demands of petroleum strategies,the general principles and specific provisions of the above-mentioned legal systems shall be given full consideration.As a result,China’s energy security and the development of national economy shall be guaranteed through sound institutions.更多还原
