拒不支付劳动报酬罪相关问题研究

【摘要】 拒不支付劳动报酬罪是刑法修正案(八)规定的一个新罪名,一直存在犯罪化与非犯罪化之争。拒不支付劳动报酬罪客观方面要求以转移财产、逃匿等方法逃避支付劳动者的劳动报酬或者有能力支付而不支付劳动者的劳动报酬,数额较大,经政府有关部门责令支付仍不支付;主观方面应以非法占有为目的;在主体的认定上,单位犯罪主体与自然人犯罪主体在某些情况下存在一定的认定难度。更多还原

【Abstract】 The crime of refusing to pay the remunerations is a new accusation ruled by Amendment to Criminal Law of the People s Republic of China(Edition 8).The controversy over the accusation has been sensational,which focuses on criminalization and non-criminalization.From the objective perspective,the crime of refusing to pay the remunerations is to transfer the properties or flee and hide,etc,so as to evade paying the remunerations or having ability to pay,but refuse to pay the remunerations,and more amount of money,and still refusing to pay it even after the related departments ordered;from the subjective,the purpose of the crime is to possess the property in an illegal way;for subjective identification,it is somewhat difficult to differentiate the subject of institutional crime from that of natural person in certain conditions.更多还原
