【摘要】 文章首先介绍了人的模式的缘起及其概念,并通过论证在法学中构建人的模式的必要性、可能性以及如何构建,论述了人的模式与法学研究的关联;其次介绍了传统法学中最具有代表性的经济人与社会人模式,逐一分析探讨了其提出的背景、内涵及进步意义。而后在此基础上结合循环经济法的特点对经济人、社会人模式进行分析,指出它们在循环经济法领域捉襟见肘,存在不足,既便是经过改良亦不适合成为循环经济法的理论基石,从而得出有必要在循环经济法领域构建一个新的人的模式的结论,最后指出在法学中构建人的模式应遵循的基本原则以及循环经济法对该新的人的模式的要求,并指出这种人的模式应为生态人模式。更多还原

【Abstract】 This paper introduces the concept of the mode of man and its origin.Through demonstrating the necessity,possibility and the way of building up this mode in law study,it discusses on the relationship between the mode of man and law study.It also talks about the mode of economic man and social man,the most representative model in traditional law study,with analysis on its background,content and significance.When analyzing the mode of economic man and social man by the characteristics of circular economy law,it points out that the mode is insufficient in the field of circular economy law,which makes it unqualified to be the theoretical foundation for the Circular Economy Law,even if with any improvement. In conclusion,it confirms the necessity to build up a new mode in the field of Circular Economy Law and elaborate the basic principles of building up the mode of man on the new requirements to this new mode of Circular Economy Law.Finally,it adds that this model types of man should be eco-mode.更多还原
