【摘要】 大学生村官政策是当前我国为建设新农村而实施的一项重大政策,取得了很大成效,但也存在一些法律问题。大学生担任村官不但没有法律依据,还违反了《中华人民共和国村委会组织法》的有关规定;由于大学生村官没有任职村的户籍,因此他们没有选举村委会成员的权利,也没有被选举为村委会成员的权利。解决这个问题有两个方法:或者修改村委会组织法第十一条,使大学生根据法律的规定直接担任村官,或者把大学生村官的户口迁移到所任职的村,使他们具有该村的户籍。更多还原

【Abstract】 The policy of the little village official is important to build new countryside in China.It has made great progress,but also has some legal issues.According to the Organic Law of the Villagers Committees of the People’s Republic of China,the policy has no legal basis and runs counter to the Organic Law of the Villagers Committees.Moreover,the little village official has not held the household register in village,so he/she has no right to vote and to be elected.Such problems can be solved either by amending Article 11 of the Organic Law of the Villagers Committees or by transferring the household register to the village so as to hold the village register.Only in this way can the university student hold the post of the village official directly.更多还原
